ESTATE PLANNING AND PROBATE OF ESTATES

Boykin Edwards, Jr., P.C. also concentrates in the area of Estate Planning, and Probate of Estates. These include preparation of Wills, Trusts, Advance Directives, Powers of Attorney, and handling all matters in the probate of estates, appointments of Executor and Administrator.

Many people do not accept the fact that they must plan to die just as they plan to live. The failure of many people to get their affairs in order result in hardship and financial loss to those family members that are left behind when an individual dies. Attorney Edwards will always emphasize to the client that failure to get their affairs in order only result in higher legal costs when someone has died and his primary interest is always to see that the surviving family members receive what they deserve and not his law firm, nor any other law firm.

Property will pass through a person’s estate either with, or without a Last Will and Testament. If there is a Last Will and Testament, the person who prepares the Will is the one who decides how their property will pass. If there is not a Last Will and Testament, the law will decide based upon what is known as Descent and Distribution. Failure to probate an estate could eventually result in family members receiving nothing.

On any estate planning done by Attorney Edwards’ Office, the passing of property is carefully considered and every possible scenario on how and to who will get the property is considered. This is based upon the careful questioning of Attorney Edwards regarding the persons involved, their age, their health and many other factors.

The Probate Courts in Georgia have multiple requirements and conditions when there is the need to probate an estate. The requirements and conditions are different when there is a Last Will and Testament compared to not having a Last Will and Testament. Attorney Edwards’ Office has handled these type matters since 1988 and have traveled throughout the State of Georgia representing clients on probate matters.

Attorney Edwards always urge everyone to get your affairs in order while you are in reasonably good health. His office has to handle many Estate Planning matters once someone has become ill, or is suffering with a terminal condition. You owe it to yourself and your family members to plan your affairs sooner rather than later.
